1. Scope
These Terms of Use govern access to and use of the MachYard website, apps and related services (the "Platform"). By using the Platform you accept these terms.
2. Role of MachYard
MachYard operates a marketplace that connects sellers and buyers of used construction equipment and provides inspection, transport and payment-handling services. Where a machine is not owned by MachYard, the sales contract is concluded between the buyer and the seller, with MachYard acting as intermediary and escrow agent.
3. Accounts
You must be a business user of legal age and provide accurate registration details. You are responsible for keeping your credentials confidential and for all activity under your account.
4. Acceptable use
When using the Platform you must not:
- publish false, misleading or fraudulent listings or bids
- circumvent the Platform to avoid fees, inspections or payment protection
- upload content that infringes third-party rights or applicable law
- scrape, reverse engineer, overload or disrupt the Platform
- use the Platform in breach of export-control or sanctions rules
5. Listings and content licence
By submitting machine data, photos or documents you grant MachYard a non-exclusive, worldwide, royalty-free licence to use them for marketing and operating the Platform. You warrant that you hold the necessary rights.
6. Suspension
We may suspend or terminate accounts that breach these terms, present a fraud or compliance risk, or repeatedly withdraw from concluded transactions.
7. Governing law
These terms are governed by Swiss law. The exclusive place of jurisdiction is Zug, Switzerland, unless mandatory consumer-protection rules provide otherwise.
